Woolwich Transfer of Development Rights Program (TDR)

In 2008, Woolwich Township enacted a powerful land preservation and smart-growth tool known as Transfer of Development Rights or (“TDR”). This comprehensive growth management program is designed to accomplish several goals critical to the Township’s quality of life, long-term fiscal health and economic prosperity. In essence, TDR establishes a mechanism that redirects growth potential away from important farmland and environmentally sensitive areas, and into locations where development and higher intensities of growth can be supported by public infrastructure, such as roads and sewer. In doing so, unwanted and costly sprawl development can be avoided in the countryside. This is accomplished by assigning transferable development rights, i.e., TDR credits to designated Sending Area properties located in the Township’s environs outside of established sewer service areas, where the preservation of private farms and open space is sought. Each Sending Area property is assigned a specific amount of TDR credits based on a complex formula that considers site constraints, acreage and zoning in place prior to 2008. In a private transaction, a Sending Area landowner or credit-holder, may voluntarily sell his or her credits to developers who can acquire TDR’s in order to realize higher intensities of development in established Receiving Areas, such as the Rt. 322 Regional Growth Center. When a Sending Area landowner sells his or her TDR’s for use by developers in a Receiving Area, their land is preserved under a deed of easement restriction, which runs with the land in perpetuity.

While TDR was adopted back in 2008, there have been a number of hurdles to its implementation. Since TDR relies on the private market and growth pressure to work, the recent economic recession represented a major a setback, as have delays in bringing public sewer and water infrastructure service to the Rt. 322 Corridor. With the pending installation of sewer and water conveyance systems, the emergence of a private market for TDRs is anticipated – especially as plans major new commercial/retail destinations advances.
